Political Dishonesty in Nebraska Politics?

The Captain notes here that in MN, Patty Wetterling (D) "...accuses Michelle Bachmann of wanting to raise taxes through an increase in the sales tax:"

Michele Bachmann says she's for lowering taxes, and yet she supports replacing the income tax with a national sales tax," says Wetterling. Under a national sales tax, all taxable goods and services - including daily basics like milk, bread, groceries, clothing, new tires and prescription drugs - could cost 23% more.

Lower and middle-class Minnesotans would pay more taxes under this plan, up to $4,077 more per year," says Wetterling. "I find it incredible that Michele Bachmann wants to place a heavier burden on the people who can least afford to pay more for basic goods and services.

Captain Ed comments:
Yeah, well, that tells only half of the story. The 23% sales tax Bachmann suggested was a replacement for the federal income tax, not an additional tax. Bachmann hasn't even endorsed the Fair Tax Plan, which would replace the income tax and is designed to be revenue-neutral -- which means that taxpayers will pay no more and no less than they already do.

Similar shenanigans are going on here in Nebraska.  Ben Nelson (D-Ne) has been running a few spots regarding Pete Rickett's supposed tax proposals…  Ben asserts that Pete would like to enact a "national sales tax" of up to 30% on homes, cars, MILK, GROCERIES, etc.  The adds do not mention it as a replacement for the federal income tax as well.

The Nelson ads are here and here.

The Ricketts response ad is here.

There appears to be some dishonesty here on two levels.  First, Pete Ricketts tax plan calls for:

The President's tax cuts ensure that everyone who pays income taxes receives tax relief, and establishes a

new 10% marginal tax rate for those at the lowest end of the income scale. This makes their taxes
significantly lower than what they paid before. I support making President Bush’s tax cuts permanent.

Lower Marginal Tax Rates
High marginal tax rates act as a disincentive for hard-working individuals to achieve the American Dream. Our tax structure must not prevent moderate to low-income individuals or families from joining the middle class. Additionally, our tax structure must not punish success or discourage risk taking by entrepreneurs and small business owners.

End the Marriage Penalty
The family is the most basic societal unit and we should not penalize marriage and family life. The Bush tax cuts reduced this penalty so that two-income couples would not be penalized on their taxes simply because they chose to get married. Before this tax change, couples had an economic incentive not to marry, which is destabilizing for society. This penalty on marriage needs to be eliminated to help promote healthy marriages and families.

Lower Capital Gains and Dividends Taxes
Low rates on capital gains taxes encourage saving and investment, habits that are good for the long-term stability of families and the American economy as a whole. Additionally, over 51 percent of Americans own stock either outright or in retirement plans like a 401(k). Reducing the dividend tax will encourage companies to return profits to investors. Giving investors a return on their investment allows them to choose whether to reinvest or spend their profits.

At some point during their life, capital gains taxes will impact almost everyone who sells a home, from older Americans seeking to move into a smaller home when their children are grown to workers who sell their house because they have taken a new job in a different city. Lower taxes on dividend income and capital gains from sales of investment assets would help stimulate the economy.

Reduce the Death Tax
Income subjected to federal taxes when it was earned should not be penalized again when an individual dies. The Bush tax cuts eliminated the death tax for estates worth less than $1.5 million dollars and gradually increases the death tax exemption until 2010 when it is eliminated. This tax reduction expires December 31, 2010, and we need to eliminate it permanently.

Eliminating the death tax is particularly important to small business owners, farmers, and ranchers. In fact, in Valentine last year during my first campaign appearance, the first voter I spoke to was a rancher who told me his number one federal concern was ending the death tax. Additionally, one benefit of eliminating the death tax is that it increases the likelihood of younger Nebraskans remaining in the state and working in the family business.

Nelson has intentionally misrepresented RIcketts' tax proposals (all very Club-for-Growth!!).  Additionally, Nelson misrepresents the FairTax in the same way Wetterling did in MN.  Even if Ricketts did support the FairTax, the Nelson ad is clearly misleading as to what the FairTax would consist of.

I'm not sure what is worse, misrepresenting your opponents tax proposals or misrepresenting the misrepresentation!!!

"Re-Enfranchising" Felons!

Betsy Newmark has a post about Democratic efforts to "re-enfranchise" felons

Roger Clegg has a powerful column today about the movement afoot in quite a few states to give felons the right to vote.
Governors in Iowa and Virginia have unilaterally restored voting rights to many felons, while legislatures in Maryland and Nebraska have liberalized their laws. At the federal level, a bill supported by Sens. Hillary Clinton and John Kerry, among others, would force states to allow felons no longer under sentence to vote. That bill is on hold, at least while the Democrats are out of power. But lawsuits in federal courts in Florida, Washington and New York have claimed that depriving felons of the franchise violates the Voting Rights Act.

As a Nebraska resident, I was curious what the current statutes were regarding felons and the right to vote.  Turns out that 2 years after completion of sentence, including parole, the disqualification is removed automatically.

See:  http://uniweb.legislature.ne.gov/LegalDocs/view.php?page=s2901012000

Section 29-112

Felon; disqualified as juror or officeholder; warrant of discharge; effect; right to vote.

Any person sentenced to be punished for any felony, when the sentence is not reversed or annulled, is incompetent to be a juror or to hold any office of honor, trust, or profit within this state, unless such person receives from the Board of Pardons of this state a warrant of discharge, in which case such person shall be restored to such civil rights and privileges as enumerated or limited by the Board of Pardons. The warrant of discharge shall not release such person from the costs of conviction unless otherwise ordered by the Board of Pardons.

Any person sentenced to be punished for any felony, when the sentence is not reversed or annulled, is not qualified to vote until two years after he or she has completed the sentence, including any parole term. The disqualification is automatically removed at such time.

I believe (no research on my part yet) that most states have remedies for convicted felons to seek reinstatement of their 'civil rights'. (ie. Voting, Possession of Weapons, Jury Duty :-)

In Nebraska, you can petition the sentencing court to set aside the conviction, resulting in, among other things:

(b) Remove all civil disabilities and disqualifications imposed as a result of the conviction.

See:  http://uniweb.legislature.ne.gov/LegalDocs/view.php?page=s2922064000

Convicted felons could also petition the Board of Pardons to set aside convictions or restore certain civil liberties, or both.

I think similar procedures are available in most states so instead of weakening the statutes in the states, felons should be reminded of their existing rights to petition the courts for reinstatement of their rights.  I think it should be handled on a case-by-case basis, instead of a blanket provision of 2 years.  Granted, it would be left up to judges and I don't necessarily trust the judges over a legislative mandate by the people but at least each case could be reviewed and evaluated according to their unique circumstances and it would be a matter of public record.

I Love Steve Martin

I found an old essay (1998) by Steve published in The New Yorker…  While running for public office, he decides to issue a public apology for some bad things he has done in his life :

Several years ago, In California, I ate my first clam and said it tasted "like a gonad dipped in motor oil." I would like to apologize to Bob 'n' Betty's Clam Fiesta, and especially to Bob, who I found out later had only one test&%$#. I would like to apologize to the waitress, June, and her affiliates, and to the DePaul family dog, who suffered the contents of my nauseated stomach.

(Ed. "&%$#" Mine)

Kos-zilla vs. MegaDLC

Jim Geraghty's TKS post from 6/20/2006 chronicling the Kos/Armstrong timeline got me thinking.  Geraghty's timeline regarding Kos/Armstrong/Mark Warner/DLC sparked some memories.  The TKS excerpt follows:

MARK WARNER

August 2005: Governor Mark Warner's PAC hires Armstrong.

        December 2005: Newsweek interviews Kos <http://www.msnbc.msn.com/id/10629288/site/newsweek/page/2/> :

Newsweek: Looking forward to 2008, what do you think of Hillary Clinton's presidential chances?

Kos: The person to watch on the Democratic side for president is not Hillary Clinton, but [former Virginia governor] Mark Warner. He showed that not only could he win in Virginia, a Red State, but he had the coattails to help his successor win. He is one of the most popular governors in Virginia history-he has a 70 or 80 percent approval rating. He'll be the anti-Hillary. Hillary is at the top now because of name recognition.

June 2006: Daily Kos readers begin to ask why Warner, with all of his ties to the Kos archenemy of the Democratic Leadership Council, is getting such praise and warm welcome from Markos at Yearly Kos. Some recent headlines in Daily Kos diaries:

I seem to recall a kerfuffle between Kos and the DLC last year...  something akin to Kos declaring war on the DLC.  As I remember it, Kos said something about wanting to make the DLC "radioactive" and telling his readers to "stay tuned".  After some searching, I found the following Kos posts:

Kos 8/22/2005 titled "The calm before the storm":
"We need to make the DLC radioactive. And we will. With everyone's help, we really can. Stay tuned. "

more:
"Ultimately, this is the modern DLC -- an aider and abettor of Right-wing smear attacks against Democrats. They make the same arguments, use the same language, and revel in their attacks on those elements of the Democratic Party that seem to cause them no small embarrassment.

Two more weeks, folks, before we take them on, head on.

No calls for a truce will be brooked. The DLC has used those pauses in the past to bide their time between offensives. Appeals to party unity will fall on deaf ears (it's summer of a non-election year, the perfect time to sort out internal disagreements)."

As I recall, that 'deadline' came and passed without a peep....  Other bloggers were following this and wondered what happened to this all-out war on the DLC:  Wizbang, Dean Esmay, Michelle Malkin, VikingPundit, Hotline blogometer, LGF.

Some started asking questions and it even go mention in the Washington Post.

It appears that shortly after Warner hired Armstrong in August 2005, Kos withdres his promise for all-out war against the DLC.  The deadline came and passed.  Some noticed and asked questions including dailykos posters and others.

Shortly thereafter, Kos, without much fanfare offered the following:

Kos 9/7/2005:
"Gotta go work on the book.

Update: Some people are asking about the DLC thing. Well, there are actually more important things right now than that. Katrina has center stage, and will for a while. "

It seems to fit the timeline of things that don't quite add up....
  1. Kos declares war on the DLC in (Aug05)
  2. Armstrong goes to work for Warner in (Aug05)
  3. Kos calls off his attack on the DLC (Sep05)

Katrina might have had center stage at the time but Kos not piling on???   Doesn't pass the smell test.

The January/February issue of Washington Monthly chronicled the events as well in a profile of Kos:

"Still, Moulitsas wouldn't back down. "No calls for a truce will be brooked," he wrote. "Appeals to party unity will fall on deaf ear... We need to make the DLC radioactive. And we will. With everyone's help, we really can. Stay tuned." As the countdown continued, Moulitsas posted millennial-sounding attacks on the DLC that veered, like the writings of the Ayatollahs, between the merely portentous and the outright ludicrous. Some liberal websites, ecstatic, began speculating about what Moulitsas's plan might be; others posted count-down clocks. And then...nothing. Three days before the scheduled unveiling, Moulitsas wrote that he'd changed his mind. Hurricane Katrina, which had just struck, had made him realize, he said, that this was not the time for intra-party bickering. "We think someone got to him," a DLC staffer told me darkly. "

Someone like Benjamin Franklin or Andrew Jackson???

What did Joe Biden know and when did he know it?

From Allah via Michelle Malkin, "What is it with the eleventh of month?"

9/11, 3/11 (Madrid) and now 7/11 (Mumbai).

This probably rises (or lowers) to the same level of Joe Biden's remarks from last week:

“you cannot go to a 7/11 or a Dunkin’ Donuts unless you have a slight Indian accent.”

Maybe that's why it occurred to me.  Why would someone bomb India on 7/11 unless they were familiar with the american stereotype of Indian convenience store workers?  Yes, it is a rhetorical question and I am actually disappointed in myself that I even made the mental connection.

In light of last weeks revelations about the plot to bomb NY/NJ commuter trains, the news of the bombings in India today give me pause.  The images of the chaos at the train stations, of injured people and frantic crowds don't have the usual luxury of being 'somewhere else'.  If it were not for the efforts of the administration that Charles Krauthammer commented on so eloquently on Special Report, I could just as easily be watching events much closer to home.

I don't know exactly how I feel and maybe that's why bombing India on 7/11 seems ironic.  I guess I'm just proud of the efforts of my President and his administration and their efforts to keep us safe at home, the NYTimes notwithstanding.

The title of the post??  Of course I'm not implying that Joe Biden had anything whatsoever to do with today's bombings in India...  I just think that his comments seem that much more inappropriate to me after today's events in the commuter tunnels of Mumbai.
